About this Unit

This unit covers the relationship between common law and equity, and the key equitable doctrines, including fiduciary relationships, equitable obligations of confidentiality, estoppel, undue influence, unconscionability and relief against forfeiture of property rights. The unit also discusses the circumstances in which third parties may be liable for breaches of equitable obligations and the full range of equitable remedies. The unit will focus primarily on equitable doctrines and remedies in the context of commercial relationships. However, other contexts will be covered, including consideration of the existence of fiduciary relationships between Indigenous Australian people and governments and the relevance of cultural norms, such as those of Indigenous Australians, to the doctrine of unconscionability.
