About this Unit

This unit focuses on the principles of contract law as they apply to construction contracts. These principles are of critical importance as over 85% of construction disputes result from breach of provisions of the contract and a failure to adequately apply the dispute resolution provisions of that contract. Discussion will include the significant legislative interventions in the field, as well as detailed discussion of the terms of a number of “standard” or industry building and construction contracts (For example AS 2124, AS 4000, ABIC). The unit will also discuss the law of torts as it relates to professional liability in the construction industry and also procurement law. The unit has been designed to address basic legal principles of construction contracts with respect to both civil works (including major infrastructure resource works) and building works.
